During a recent House Energy and Commerce Subcommittee hearing, Congresswoman Julie Fedorchak (R-ND) addressed the challenges faced by smaller Division One schools in the evolving Name, Image, and Likeness (NIL) landscape. She emphasized the need for a national NIL standard that would benefit institutions like the University of North Dakota and North Dakota State University.

Congresswoman Fedorchak highlighted the disparity in budgets among Division One institutions, questioning how national NIL policies could avoid disproportionately benefiting larger programs while marginalizing smaller conferences. Mr. King responded, stating that “having uniformity is obviously important” to ensure fair regulation across states and prevent unregulated practices.

The discussion also touched on the issue of retaining talent at smaller schools. Ms. Montgomery expressed concerns about the lack of regulation around NIL agents and roster tampering. She suggested that uniform laws could help student-athletes confirm legitimate opportunities before making decisions, potentially curtailing tampering.

On enforcing NIL rules, Congresswoman Fedorchak asked about concerns regarding the governing commission established in a settlement. Mr. Huma advocated for a neutral third-party enforcement mechanism to protect athletes’ interests. Mr. King added confidence in the College Sports Commission’s ability to regulate institutional revenue sharing and enforce NIL rules effectively.
